Stepparent and Second Parent Adoption and Orders of Parentage
If a child is born into your marriage or civil union, an order of adoption or parentage is still a requirement to create legal parentage for the parent who did not give birth to the child or has no genetic relationship to the child. Following the United States Supreme Court decision establishing the constitutional right to gay marriage, recent LGBTQ-friendly legislation in New Jersey and New York, and court decisions in Pennsylvania, you have the right to obtain an order of adoption or parentage.
Birth certificates are rarely recognized as proof of parentage. This means that, if you are a non-birth parent of a child in an LGBTQ family, you must use a second parent adoption or parentage proceeding to secure your legal parentage rights to your child.
